Dhoraji Rape Case: Dhoraji Sessions Court with Sagira in Bhayavadar in Rajkot has sentenced the accused to 20 years. However, the Gujarat High Court has stopped the accused’s 20 -year sentence and granted bail due to the DNA mismatch.
Ahmedabad: The Gujarat High Court has granted the convict Madhav Waghela’s 20 -year sentence in the rape case. He has also been granted bail. It may be recalled, a complaint was lodged under the POCSO Act in this case. Madhav was accused of raping a 14 -year -old girl. In February 2025, the Dhoraji court in Rajkot district convicted him. However, the investigation revealed that the victim’s DNA sample and Madhav Vaghela’s DNA did not match. Nevertheless, the court sentenced him on the basis of other evidence and the girl’s statement.
Request to rock the sentence
It may be recalled that after this, Madhav Waghela appealed to the High Court and requested to stop his sentence. His lawyer Rathin Rawal argued that the DNA report did not prove that he was the father of a pregnant child.
Birth Certificate has not been submitted
It may be recalled that the lawyer also raised the question that the trial court did not find completely reliable evidence about the girl’s age. The birth certificate was not presented, only depending on the school record.
The court imposed a temporary rock on the convict’s sentence
After hearing the case, a bench of Judge Ilesh Vora and Judge Sandeep Bhatt said that the source of the birth date mentioned in the school record was not registered in the record. Therefore, the lower court did not properly evaluate the matter. The court said that the culprit was temporarily stopped and bail was granted on the guilty.
It is worth mentioning that the brother -in -law of Sagira, who was the victim before the PSI RV Bhimani at the Bhayavadar police station, had lodged a complaint with the accused, in which the accused had kept the misdemeanor with a 14 -year -old Sagira. The complaint was filed in the Dhoraji sessions court after the complaint, in which the accused Madhav Dia Waghela resident Bhayavadar was sentenced to 20 years in prison.
