Jamshedpur News: Bhagwat Singh on Wednesday filed an appeal against NCLT’s orders on behalf of employees at the NCLAT (Appeal Authority) in Jamshedpur-New Delhi on January 8, 2025. In the appeal, Bhagwat Singh said that the NCLT has rejected the valid claims of about 2000 workers of Jamshedpur plant in Incub, without giving any valid reasons. The NCLT had ordered that the allegation against the former resolution was meaningless by removing Shashi Agarwal. For this reason NCLT has denied this application. However, P.F. By passing the order on the application of the department, the new resolution professional Pankaj Tibrav AL has a PF. Ordered to make full arrangements in the resolution plan and to make a full arrangement for the gratuity of the workers, which is only possible when the true and legal claims are accepted.
Advocate Akhilesh Srivastava Request
Bhagwat Singh said that he had urged Advocate Akhilesh Srivastava to fight this war in NCLAT for the good laborers of the Inclab Company, as it is a question of the death of 2000 families and Tata Company is willing to capture the land of Inkb, who also informed that many of the houses were taken over. And some people have rented it. In these homes, accidental life and wealth, such as the collapse of the Tio Colony and the old buildings, can damage life and wealth. Therefore, they will also increase this in NCLAT. Workers in their appeal requested in the NCLAT that NCLT did not have any loan document given to Inkb in 1998 and if I believe ICICI, Axis, HSBC and City Banks were also given some loans in 1998, all these loans were full. By September 2017, there is no responsibility for Katrat and Inkb after September 30, 2017. According to Bhagwati Singh, in the petition, the workers have also told the NCLAT that the Delhi High Court has clearly written in its order on January 06, 2016 that all banks and financial institutions have to pay only Rs 21 crore Rs 63 lakh but fake claims are Kamala Mills, Pt. The Delhi High Court order was approved from 4000 crores of fake companies like GAS Gusus, Tropical Adventure, etc.
NCLTA completely ignored the established law
According to Bhagwati Singh, the petition states that the NCLT had to take only the decision that a loan of 21 crore 63 lakhs fixed by the Delhi High Court, it has been timeless and no inkb was left on August Gust 2019. Whether or not, the NCLT passes completely and pass the order. In his appeal, the workers also told NCLAT that according to the Surfice Act and the Reserve Bank’s guidelines, banks’ non -executed assets (NPAs) can only be sold with banks and asset reconstruction companies, which have been registered with the Reserve Bank. They can be sold. This established law was completely ignored by the NCLT and has passed the order.
NCLT also ignored the order
The workers also stated in their appeal that the NCLT also ignored the NCLAT order on June 04, 2021 and approved a committee of illegal creditors made by Shashi Agarwal, which approved Vedanta’s illegal resolution plan and to restore the appropriate Income Company. Is, reject their requests. The appeal further states that Ramesh Ghamandiram Govani has not given any instruction to the resolution professional for receiving the re -recover of Rs 500 crore in Incob. Pankaj Tibrawal has not ordered any order against the five crore inquiries by appointing four new resolution professionals in the fraud.
